General Terms and Conditions
1. Guarantees
Should the goods be found to have obvious material or manufacturing faults, including damage due to transport, please notify us, or the delivery company's employee who delivers the item, about such faults immediately. Your legal rights are however not affected if this notification is not made. For all defects to the purchased item that become apparent during the warranty period, you may choose between the statutory claim to supplementary performance, remedial measures/replacement delivery - where statutory conditions apply - the continuing claim to a reduction in price or termination alongside damages including compensation for any damage instead of performance as well as compensation for your fruitless expenditure.
2. Return Policy
2.1. Right of Return
You may return the received goods without stating a reason within two weeks by sending them back. The period commences after receipt of these instructions in writing (e.g. by letter, fax, email), however not before they have arrived at the recipient and not before our duties to perform have been complied with in accordance with Article 312 c Section 2 of the German Civil Code in conjunction with Article 1, Sections 1, 2 and 4 GDB Invo V e Section 1, Paragraph 1 of the German Civil Code in conjunction with Article 3 German Civil Code-InfoV. The timely despatch of the goods or return request shall be sufficient to comply with the deadline. In all cases we bear the cost and risk of the return. Please address requests for return to.

Unfortunately we cannot grant a right of return for the delivery of goods that are prepared to your specifications, clearly tailored to your personal requirements or, due to their nature, are not suitable to be returned.
2.2. Consequences of returning goods
In the case of an effective return, mutually provided performance shall be restituted and any applicable benefit enjoyed (e.g. benefits from use) shall be surrendered. Compensation may be requested where the goods have deteriorated. This does not apply if the deterioration of the goods is due exclusively to inspection - as may occur in a retail business. Furthermore you can avoid the obligation to compensation for existing deterioration caused by the intended use of the goods by not using the goods as your own property and refraining from anything that could affect their value. Obligations to refund payments must be complied with within 30 days. For you, the period begins when the goods or return request are despatched and for us when they are received.
3. Prices
All previous prices are no longer valid once the current catalogue is published. These prices apply until publication of the next catalogue. We accept no liability for printing errors regarding pricing details. These prices remain valid until publication of the next catalogue. Our prices include the currently applicable VAT for deliveries within the Federal Republic of Germany.
4. Deliveries abroad
The currently applicable rate of VAT applies to deliveries to countries within the European Union (EU). For orders from outside the EU we deduct the included German VAT from our prices. You must however pay the applicable import sales tax for the country concerned. We are unable to provide information regarding the collection of customs duties. You shall receive from us a declaration of origin printed on the invoice. Payments from foreign banking institutions do not incur additional fees within the EU if you include the below IBAN and SWIFT codes for our bank account on the remittance. Without these codes your payment will only be credited to us after a deduction of €7.00, which we must charge in addition if you do not make the transfer from a German financial institution.

5. Domestic shipping costs
We charge €5.00 shipping costs for every order. Obviously we shall only charge shipping costs once if, for technical reasons, we deliver your order in several stages.
6. Foreign shipping costs
We charge €10.00 shipping costs for every order.
7. Payment options
You can make payment: by credit card: Payment by Paypal, Visa or Mastercard is made in advance. All personal details are SSL-encrypted when transmitted. The delivered goods shall remain the property of Auerberg Produkte GmbH & Co. KG until payment has been made in full.
8. Delivery
We use courier companies as the fastest way to deliver - normally within a few days. But please remember that our products are not mass-produced items. We are not always able to avoid prolonged delivery times. In such cases we can deliver your order in stages.

10. Miscellaneous
Our offer is non-binding and only applies within the Federal Republic of Germany. Because our products are not mass-produced items, slight discrepancies from the pictures and details in the catalogue may occur. In order to process your order we store your address and data relating to the order. Naturally we undertake to fully protect your personal data in accordance with the provisions of German Federal Laws of Data Protection. Furthermore we assure you that we will not pass on your address details to third parties. Delivery contracts entered into with us are subject in all cases to German Law, this includes foreign countries, i.e. orders from or to abroad. As long as both parties to the contract are registered traders, jurisdiction lies with the local court for Munich.
11. Severability Clause
Should one of the provisions of these terms and conditions be or become invalid, the remaining terms and conditions shall remain valid. The invalid provision shall be replaced by another that comes as close as possible to it.
